mr. kyl: thank you. mr. president, we're going to be taking up the so-called hire act, i believe, starting tomorrow. and i wanted to address some of the problems with this since the procedure under which we have considered this bill does not allow any amendments. and as a result, we have no opportunity to fix problems that i think are inherent in the bill and will force me to vote against it. the first provision that should be highlighted is the provision called the build america bonds. this was created first in the 2009 stimulus bill. it offers a direct subsidy from the federal government to states and other governmental entities to cover their cost to financing for certain kinds of projects. the house-passed bill expands this subsidy by allowing for current tax preferred bonds to qualify under the direct subsidy under this program and increases the generosity of that subsidy to cover all of the borrowing costs for education projects. this will mean an expansion of the already substantial support that the f

mr. kyl: mr. president? the presiding officer: the senator from arizona. mr. kyl: we're fortunate to have a real doctor, a physician, dr. coburn of oklahoma, as one of our colleagues here in the united states senate to talk about the real impact of legislation like this as he sees it when he treats his patients. and i think his words deserve a lot of attention. i just wanted to briefly address this morning a couple of the claims that my democratic colleagues are making about this new legislation, claims that are simply false. the first one: there's a big tax cut. one of my colleagues said this is the biggest tax cut we've ever had. there is no tax cut for taxpayers in this bill. what they're touting as a tax cut is rather a direct payment to insurance companies. i find it very odd that that's called a tax cut. when i think of a tax cut, i think of money remaining in the pockets of taxpayers. we're going to say you don't have to pay taxes that you've been paying in the past. that's not what's in this bill. what this bill does is to provide a subsidy to insuranc

mr. kyl: mr. president, until my voice gives out, i'd like to address the bill that's on the floor here. the bill that has been denominated by my colleagues on the democratic side as a jobs bill, but which won't create any new jobs, and when considered in conjunction with the health care legislation, that the president has proposed will actually cost jobs, and i'd like to address that. this legislation extends some current provisions of law, including tax provisions, unemployment compensation, cobra insurance. it extends a provision of federal subsidies to the states for medicaid, and there are a few other provisions. none of these create new jobs. the tax extenders are youthful. that's our washington, d.c., speak for provisions of the tax code that last one year and have to be renewed each year. they are generally to enable businesses to deduct from their taxes ordinary business expenses. and include things like research and development tax credits which i think are supported by all 100 senators

mr. kyl: mr. president, this evening there is a vote scheduled on the ensign amendment which would amend an archaic legislation called the d.c.a. perimeter rule, limited travel options for those that fly out of ronald reagan national airport or d.c.a. as it is called. the rule restricts the departure or arrival of nonstop flights to or from airports that are beyond 1,250 miles from d.c.a. this restriction forces passengers coming from western states or going to western states to use either dulles international airport or to connect in some other city and then come on in. obviously this is inconvenient and discriminatory. the rule was first codified as a federal statute in 1985, but actually it goes back to you 1962 -- it goes back to 1962. it first had existed as a federal rule in its various iterations since the 1960's when dulles was first built. the original purpose of the d.c.a. perimeter rule was to establish dulles as the long-haul airport serving the washington area, and that has worked n.1

mr. kyl: mr. president, picking up on the comments of my colleague, the republican leader, there is another distressing story in the paper today. it's reported by the associated press that all of the special deals that last week the president said he was going to try to remove from the legislation, now they say, except for the cornhusker kickback, they're going to leave them in there because they need the votes. and if that's correct, mr. president, this process is even sicker than we thought that it was. part of the reason for the democratic leadership using the reconciliation provision to fix the senate bill was to take all of these special provisions out. but now it appears, according to the associated press, that they're going to be kept in there because they need the votes. the let me just detail a couple of what these are. from last week there was a story in "politico" that detailed six specific items. of course the cornhusker kickback that got such bad publicity that everybody agreed it had

mr. kyl: i want to respond to my colleague. the point i was making is it is hard to describe this as a jobs bill because it doesn't create jobs. each year we extend these tax provisions, that's why we in washington call it the tax extenders bill, this isn't some new job creator. i agree with my colleague that to the extent that we continue this in practice, though everybody who takes advantage of it knows that it will be extended, so they haven't made decisions based on the prospect that we aren't going to do it. they know we're going to do it retroactively. so it is not creating any new jobs. i support the extension. i think it is a good thifnlg but let's don't call it a jobs bill. by contrast, the health care legislation that my colleague supports is a job killer. and i pointed out just one provision -- 115,000 jobs per year lost just because of the one provision -- taxing the so-called passive income, the dividends, and we're not even sure whether capital gains are taxed in that, and so their estimates may even be low. so th
